Welcome to INDIVISUAL (the "Platform", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, AI-powered design tools, and all related services (collectively, the "Services").

By creating an account, placing an order, uploading content, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Who We Are

INDIVISUAL is the storefront brand operated by Dujue Technology (Shenzhen) Co., Ltd. (独觉科技（深圳）有限公司) for this first-version storefront, unless the checkout provider or order document identifies a different merchant of record for a specific transaction. You can reach us at:

2. Eligibility

You must be at least 13 years old (or 14 years old if residing in Mainland China) to create an account and use the Services. If you are under the age of majority in your jurisdiction, you must have your parent or guardian's consent.

We may refuse service, terminate accounts, or cancel orders at our sole discretion, including if you violate these Terms.

3. Your Account

You are responsible for:

• Keeping your login credentials confidential
• All activity that occurs under your account
• Notifying us promptly at security@indivisualhub.com of any unauthorized use

We recommend using a strong, unique password and enabling two-factor authentication when available.

4. Orders and Payment

4.1 Product information

We make every effort to display our products accurately. However, colors, textures, and fit of physical products (especially customized phone cases) may differ slightly from on-screen previews due to screen calibration and manufacturing tolerances.

4.2 Pricing

All prices are shown in the currency selected for your region. Prices do not include applicable taxes, duties, or shipping unless explicitly stated. We reserve the right to change prices at any time, but price changes do not affect orders already placed and confirmed.

4.3 Payment

We accept the payment methods displayed at checkout. By submitting payment information, you represent that you are authorized to use the selected method. Payment must clear before we produce or ship your order.

4.4 Order acceptance

Your order is a binding offer to purchase. We accept your offer when we send an order confirmation email and begin production. Until then, we may decline or cancel the order (e.g., for pricing errors, suspected fraud, product unavailability, or legal restrictions in your shipping destination).

4.5 Customized products

Customized products (including all phone cases designed via our Designer) are made to order and non-refundable except in cases of:

• Manufacturing defect
• Shipping damage
• Wrong item delivered (our error)

5. User-Generated Content (UGC)

Our Services include a Designer that lets you upload images, add text, and combine stickers to create custom products. This section governs your submissions.

5.1 Your responsibility

You are solely responsible for any content you upload or generate ("Your Content"), including:

• Original artwork you create
• Photos of yourself, friends, family, pets
• Any combination of stickers, text, and images

5.2 Your warranties

By submitting Your Content, you represent and warrant that:

• You own or have the rights to use all content you upload, including copyrights, trademarks, rights of publicity, and any necessary model releases
• Your Content does not infringe any third party's intellectual property, privacy, or other rights
• Your Content complies with our Content Guidelines (no pornography, hate speech, violence, illegal activity, etc.)

5.3 License to us

You grant us a non-exclusive, worldwide, royalty-free license to use Your Content solely for:

• Producing the physical product you ordered
• Displaying it in your own account dashboard
• Supporting your order, customer-service, fraud-prevention, and production records
• Displaying it publicly only if a publishing feature is later made available and you separately choose to publish

You retain ownership of Your Content. Ending your account or deleting the content terminates this license for future use (we may retain records to fulfill past orders and comply with legal obligations).

5.4 Prohibited content

You may NOT upload content that:

• Is pornographic, violent, or glorifies illegal activity
• Infringes any trademark, copyright, right of publicity, or other IP right
• Contains hate speech, harassment, or discrimination based on protected characteristics
• Depicts children in suggestive contexts
• Impersonates another person without authorization
• Violates any applicable law in your jurisdiction or in the jurisdiction where the product will be shipped

We reserve the right to remove content, cancel orders, and terminate accounts that violate this section — with or without notice.

5.5 IP infringement complaints

If you believe Your Content or someone else's content on our Platform infringes your rights, please file a notice at ip@indivisualhub.com with:

• Identification of the protected work
• The URL or design ID of the infringing content
• Your contact information
• A good-faith statement and signature

We follow a notice-and-takedown process and will remove infringing content promptly upon verified complaint.

6. Intellectual Property

6.1 Platform IP

The Platform itself — including our logo, website design, source code, written content, stock stickers, AI models, and all proprietary technology — is owned by us or our licensors and protected by intellectual property laws. You may not copy, reproduce, modify, or create derivative works without our written permission.

6.2 Stock stickers and templates

Stickers, backgrounds, and design templates provided in the Designer (free or paid) are licensed to you for personal, non-commercial use within the Designer, solely to create products you order from us. You may not redistribute, resell, or extract these assets.

7. Prohibited Conduct

You agree not to:

• Use the Services for any illegal purpose
• Interfere with, probe, or disrupt any service or server
• Reverse engineer, decompile, or extract source code
• Scrape, harvest, or mass-collect user data
• Transmit viruses or malicious code
• Use automated tools (bots, scripts) to place orders or flood systems
• Resell our products commercially without an authorized reseller agreement

8. Pricing Errors

If a product is mistakenly listed at an incorrect price, we reserve the right to refuse or cancel orders placed at that price, even after order confirmation. We will refund any amount charged.

9. Suspension and Termination

We may suspend or terminate your account at any time if you:

• Violate these Terms or our policies
• Engage in fraud, chargebacks, or abuse of our refund policy
• Upload prohibited content repeatedly
• Create multiple accounts to evade restrictions

You may close your account at any time by contacting support@indivisualhub.com or via Account Settings. Closing your account does not cancel paid orders in production.

10. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including (but not limited to) merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

We do not warrant that:

• The Services will be error-free or uninterrupted
• Defects will be corrected
• The Services are free of viruses or harmful components

11. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from these Terms or your use of the Services shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) USD 100.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or reputation.

Some jurisdictions do not allow limitation of certain liabilities; in those places, our liability is limited to the maximum extent permitted.

12. Indemnity

You agree to indemnify and hold us harmless from any claims, damages, or costs (including reasonable attorneys' fees) arising from:

• Your Content
• Your violation of these Terms
• Your violation of any third party's rights

13. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains what personal data we collect and how we use it.

14. Modifications

We may update these Terms from time to time. When we do, we will:

• Update the "Effective Date" above
• For material changes, notify you via email or an in-app banner at least 14 days before the new terms take effect
• Ask you to re-agree upon your next login if changes are significant

Continued use of the Services after the Effective Date constitutes acceptance of the updated Terms.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the People's Republic of China, without regard to conflict of law principles, except where mandatory consumer-protection laws in your place of residence require a different rule.

Any dispute arising out of these Terms shall be resolved through:

1. Good-faith negotiation (first 30 days)
2. Mediation, if negotiation fails
3. If still unresolved, a court or dispute forum with jurisdiction under applicable consumer and civil procedure law

For users in the EU, UK, or other jurisdictions where consumer protection law requires, you retain the right to bring claims in your local courts.

16. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.
